DATA TREATMENT
The Political Constitution of Colombia establishes the right of all people to know, update and rectify the information that exists about them in databases or files of public or private entities. Likewise, it orders those who have Personal Data of third parties to respect the rights and guarantees provided for in the Constitution when this type of information is collected, processed and circulated.
Likewise, the Political Constitution of Colombia establishes the right of any person to information, so that they receive truthful and impartial information.
AV® is committed to complying with regulations regarding the protection of Personal Data and respecting the rights of the Owners of the information. For this reason, it adopts this Personal Data Processing Policy of mandatory application in all activities that involve Personal Data Processing and mandatory compliance by AV®, its administrators, collaborators and third parties with whom it has a contractual or contractual relationship. commercially.
The Processing of Personal Data may be carried out through physical, automated or digital means according to the type and form of information collection.
The following are the uses of personal data:

- Develop the selection, evaluation, and employment process, as well as the processes required to fully comply with the employment relationship, including the granting of benefits.
- Support internal or external audit processes.
- Register the information of employees and/or pensioners (active and inactive) in the AV® databases
- Those indicated in the authorization granted by the data owner or described in the respective privacy notice, as the case may be.
- Provide, share, send or deliver your personal data to affiliated, linked or subordinate companies of AV® located in Colombia or any other country in the event that said companies require the information for the purposes indicated here.
- Deliver your personal data to insurance companies when strictly necessary to cover AV® risks.
- Carry out marketing, sales and promotional activities, telemarketing (telephone marketing), customer service, brand activation activities, awards and promotions, directly or through third parties derived from commercial alliances or any link.
- Implement relationship strategies with clients, suppliers, shareholders and other third parties with whom the Company has contractual or legal relationships;
- Make invitations to events, improve products and services or offer new products, and all those activities associated with the commercial relationship or existing link with AV® or the one that it may have.
- Among others, without exceeding the limits of the law.
Authorization for Data Processing
We obtain the authorization of the owner through any means that may be subject to subsequent consultation, such as the website, forms, formats, activities, contests in person or on social networks, PQR formats, data messages or apps.
If personal data is provided, said information will be used only for the purposes indicated here, and therefore, AV® will not proceed to sell, license, transmit, or disclose it, unless:
- There is express authorization to do so.
- It is necessary to allow contractors or agents to provide the entrusted services.
- It is necessary in order to provide our services and/or products
- It is necessary to disclose it to entities that provide marketing services on behalf of AV® or to other entities with which there are joint market agreements.
- The information is related to a merger, consolidation, acquisition, divestiture, or other corporate restructuring process.
- That is required or permitted by law.
- AV® may subcontract to third parties for the processing of certain functions or information.
When the processing of personal information is actually outsourced to third parties or personal information is provided to third-party service providers, AV® warns said third parties about the need to protect said personal information with appropriate security measures, the use of the information to own purposes and it is requested that personal information not be disclosed to others.
Rights of personal data holders
The holders of personal data themselves or through their representative and/or attorney-in-fact or their successor in title may exercise the following rights, with respect to the personal data that is subject to processing by AV®
Right of access: Under which you may access personal data that is under the control of AV®, for the purposes of consulting it free of charge at least once every calendar month, and every time there are substantial modifications to the Treatment Policies. of information that motivates new queries.
- Right to update, rectification and deletion: Under which you may request the updating, rectification and/or deletion of the personal data being processed, in such a way that the purposes of the treatment are satisfied.
- Right to request proof of authorization: except in events in which, according to current legal regulations, authorization is not required to carry out the treatment;
- Right to be informed regarding the use of personal data
- Right to file complaints with the Superintendence of Industry and Commerce: for violations of the provisions of current regulations on the processing of personal data.
- Right to require compliance with orders issued by the Superintendence of Industry and Commerce.
- For the purposes of exercising the rights described above, both the owner and the person who represents him or her must demonstrate their identity and, if applicable, the capacity by which they represent the owner. The rights of minors will be exercised through the people who are authorized to represent them.
The data processing policy can be consulted at www.alejandravaldivieso.com. In the event that sensitive personal data is collected, the owner may refuse to authorize its processing.
AV® will be responsible for addressing the requests, complaints and claims made by the current data owner, with the exception of that described in paragraph e). Right to file complaints with the Superintendency of Industry and Commerce.
